MOHAVE COUNTY BOARD OF SUPERVISORS MOHAVE COUNTY, KINGMAN, ARIZONA REGULAR MEETING MARCH 7, 2001 The Board of Supervisors of Mohave County met in Regular Session this 7th day of March 2001, at 9:30 AM. In attendance were Pete Byers, Chairman; Tom Sockwell and Buster Johnson, Members. The meeting was called to order by Chairman Byers, followed with the invocation and the Pledge of Allegiance given by Reverend Grif Vautier of the Kingman Presbyterian Church of Kingman. The following Mohave County Elected Officials and Department Heads were also in attendance and addressed specific items as noted: Richard A. Skalicky, P.E., Interim County Manager; Chris Ballard, Planning and Zoning Director; Deborah Herbert, Chief Civil Deputy County Attorney; Christine Nelson, Civil Deputy County Attorney; Patty Mead, Health and Social Services Director; and Pat Chastain, Clerk of the Board. Motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to call for an Executive Session to be held March 19, 2001, at 9:00 AM for discussion and consultation with legal counsel in accordance with A.R.S. 38-431.03 (A) (3) & (4) to discuss items noticed on the agenda with an asterisk.. ITEM 2: Supervisor Sockwell read into the record the following letter from the Dolan Springs Community: As we travel through life we do not take time to appreciate the fact that there are people in our society who care for the wants and needs of other people. You and your staff has displayed the true character of peoples desire to help and uplift others by the gracious application of these much needed grant monies. We, the community of Dolan Springs, wish to thank you for the expeditious manner in which you responded to our request to aid the elderly and lower income residents of our town. We are very grateful and are certain this grant money will be put to the best possible use within this community. Signed by the community of Dolan Springs. Supervisor Sockwell expressed thanks. Chairman Byers advised that he had attended a meeting in Flagstaff with the Supervisors and the Mayors of Northern Arizona. Chairman Byers stated that he had advised those in attendance, at that meeting, that Mohave County could not afford to be a member in any more organizations, but would personally agree to meet twice a year after the close of the session of the Arizona Legislature. ITEM 3: Interim Manager Skalicky advised that he had attended the National Association of Counties Conference in Washington D.C., and one of the meetings dealt with septic tank issues. Interim Manager Skalicky stated that it was interesting to note that everyone had the same problem, and that the federal government may be getting involved through Environmental Protection Agency (EPA) guidelines. Interim Manager Skalicky noted there was a lot of discussion regarding the Florida voting issue, regarding hanging chads and the punch card system, with discussion that went from the need for the Federal government to buy a new system for everyone, to adopting a non-funded mandate to change the system. ITEM 4: Motion was made by Supervisor Sockwell, seconded by Supervisor Johnson, and unanimously carried to approve the January 8, and 22, 2001, Board of Supervisors Meeting minutes as most recently drafted. Motion was made by Supervisor Johnson, and seconded by Supervisor Sockwell, to approve the Consent agenda minus items 46, 47, 48. It was noted, by the Clerk of the Board, that the Consent Agenda ended with item 38. Adoption of Board of Supervisors Resolution No. 2001-84 - Rezone of Lots 145 and 160, Lake Havasu Highlands, Tract 1085-B, in Section 21, Township 14 North, Range 20 West, from C-2 (General Commercial) zone to C-2H (General Commercial Highway Frontage) zone, in the Lake Havasu City Area (west side of London Bridge Road, between Quartzite Place and Perlite Place), Mohave County, Arizona, as recommended by the Planning and Zoning Commission. 6. Approve and authorize the County Manager to execute Mohave Engineering Association, Inc.s, Change Order No. 1, in the amount of $52,468 for additional services related to the SCADA signalization system, and for additional field inspection and project management services. 18. Adoption of Board of Supervisors Resolution No. 2001-104 Application to the Governors Office of Highway Safety FY 2002 traffic safety grants, as requested by Tom Sheahan, Mohave County Sheriff. 30. Award of Bid No. 01-B-03 Fast Dry, Water Borne, Non-Lead Traffic Paint to TMP-Pathway, LLC, Salem, Oregon, in the amount of $32,887.20 plus applicable tax. 31. Approve rejection of Bid No. 01-B-02 Dismantling, Relocating, Reconstruction and Site Work for Two (2) Modular Buildings in Dolan Springs, sole bid from General Modular Sales & Leasing, Inc., Scottsdale, Arizona. 32. Approve proposed settlement of indigent healthcare case titled Phoenix Regional Medical Center, et al. v. Mohave County, CV-99-318, and authorize settlement payment amount of $10,000 to be paid from County contingency funds and transferred to AHCCCS budget. 33. Approve Original Liquor License application for Robert Mason, DBA Wild Bills Stage Stop, 4305 Highway 68, Golden Valley, Arizona, Series No. 12. 34. Approve Special Event Liquor License for the Knights of Columbus, 2255 Butler Ave., Kingman, Arizona, on March 17, 2001. 35. Approve Special Event Liquor License for the Golden Valley American Legion Post 22, 3435 Verde Road, Golden Valley, Arizona, on July 4, 2001, and December 31, 2001. 36. Approve the County Managers Ordinance Report for the time period of January 26, 2001, through February 15, 2001. 37. Authorize the payment of expenditures for Board of Supervisors. 38. Approve reappointment of Taylor Ross, Bonnie Willett, Angie Wilks, and Victor Wakimoto to the Mohave County Extension Advisory Board. Motion was made by Supervisor Sockwell, seconded by Supervisor Johnson, and unanimously carried to refer Items 46 and 47 back to the Mohave County Planning and Zoning Department, due to a possible posting requirement challenge, as follows: ITEM 46: Evaluation of a request for a Rezone of Lots B and C, Block 1, Lovin's Subdivision Of The Town Of Oatman, in Section 14, Township 19 North, Range 20 West, from R-E (Residential-Recreation) zone to C-2H (General Commercial Highway Frontage) zone, in the Oatman portion of the Mohave County General Area (south side of Oatman Road [Old US Highway 66] approximately one mile south of Silver Creek Road), Mohave County, Arizona. (Commission Approved By Unanimous Vote Resolution No. 2001-96) ITEM 47: Evaluation of a request for a Zoning Use Permit on Lots B and C, Block 1, Lovin's Subdivision Of The Town Of Oatman, in Section 14, Township 19 North, Range 20 West, for a swap meet in a C-2H (General Commercial Highway Frontage) zone, in the Oatman portion of the Mohave County General Area (south side of Oatman Road [Old US Highway 66] approximately one mile south of Silver Creek Road), Mohave County, Arizona. (Commission Approved By A 4-2 Vote Resolution No. 2001-97) ITEM 39: Lucille Laswell, applicant, addressed the Board requesting approval of a Zoning Use Permit on Lot 5, as shown on Record of Survey, Book 15, Page 45, in the SE NE NE of Section 21, Township 39 North, Range 16 West, for a secondary residence in an A-R (Agricultural-Residential) zone, in the Arizona Strip Area (south of Elbow Canyon Road and west of Arvada Road), Mohave County, Arizona. Ms. Laswell stated that, in her opinion, there was no problem with access as there were three accesses to her property. Director Ballard advised that the legal access issue was because there were gaps in legal access to Elbow Canyon Road, which would be cleared through the Scenic Improvement District effort, as well as Right-of-Way on Western, even though physical roads were there. Interim Manager Skalicky advised that Mohave County had been working for fourteen years to secure those Rights-of-Way even though Elbow Canyon Road was a County Highway and maintained on a regular basis. Motion was made by Chairman Byers, and seconded by Supervisor Sockwell, to reverse the Planning and Zoning Commissions recommendation to DENY the Zoning Use Permit, and adopt Board of Supervisors Resolution No. 2001-83 approving the Zoning Use Permit. At the request of Supervisor Johnson motion was withdrawn, and a substitute motion was made by Chairman Byers, seconded by Supervisor Johnson, and unanimously carried to refer the matter back to the Planning and Zoning Commission. ITEM 40: Darrell Karn, applicant, addressed the Board regarding the evaluation of a request for a Rezone of Lots 35 and 50, Lake Havasu Highlands, Tract 1001, in Section 21, Township 14 North, Range 20 West, from C-2 (General Commercial) zone to C-2H (General Commercial Highway Frontage) zone, in the Lake Havasu City Area (west side of London Bridge Road, between Bryden Street and Sapphire Street), Mohave County, Arizona. (Commission DENIED By Unanimous Vote Resolution No. 2001-85). Mr. Karn gave extensive testimony that this request was to allow the construction of a steel building to house his car collection and would only be a private garage. Mr. Karn noted that he had not attended the Planning and Zoning Commission Meeting to advise them of the purpose of his request. Supervisor Johnson noted there were objections from the neighbors based on potential for ground pollution from automobile fluids, use being incompatible with the residential neighborhood, decrease of property values, potential noise and danger to children, and increase in traffic. He felt that these issues needed to be settled by Mr. Karns and the neighborhood. Motion was made by Supervisor Sockwell, seconded by Supervisor Johnson, and unanimously carried to refer the request back to the Planning and Zoning Commission to allow the applicant to address the objections of the neighbors and the Fire Department. ITEM 41: Motion was made by Supervisor Johnson, seconded by Chairman Byers, and unanimously carried to adopt Board of Supervisors Resolution No. 2001-89 Rezone of a portion of Section 23, to be subdivided and known as The Coves On The Colorado River, Tract 4173, in Township 17 North, Range 22 West, from R-E (Residential-Recreation) and C-2 (General Commercial) zones to R-O (Single Family Residential/Mobile Homes Prohibited), A-R (Agricultural-Residential), C-MO (Commercial-Manufacturing/Open Lot Storage), C-2 (General Commercial), C-RE (Commercial-Recreation) and R-E (Residential-Recreation) zones, in the South Mohave Valley Area (south of Plantation Road, west of Mountain View Road and north of the Colorado River), Mohave County, Arizona, as recommended by the Planning and Zoning Commission. ITEM 42: Motion was made by Supervisor Johnson, seconded by Chairman Byers, and unanimously carried to adopt Board of Supervisors Resolution No. 2001-90 Preliminary Subdivision Plan And Petition Of Exception for The Coves On The Colorado River, Tract 4173, being a proposed subdivision of a portion of Section 23, Township 17 North, Range 22 West, in the South Mohave Valley Area (south of Plantation Road, west of Mountain View Road and north of the Colorado River), Mohave County, Arizona, as recommended by the Planning and Zoning Commission. ITEM 43: Motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to adopt Board of Supervisors Resolution No. 2001-92 - Zoning Use Permit on Parcels A and B, as shown on Parcel Plats Book 4, Page 67, in Section 15, Township 18 North, Range 22 West, for a commercial modular office in a C-2H/1A (General Commercial Highway Frontage/One Acre Minimum Lot Size) and M (General Manufacturing) zones, in the South Mohave Valley Area (west side of State Highway 95, between Jerome Avenue and Hulet Avenue), Mohave County, Arizona, as recommended by the Planning and Zoning Commission. ITEM 44: Annette Holmquist, representing the applicant, addressed the Board regarding the evaluation of a request for a Rezone of the E SW SW SW of Section 21, Township 27 North, Range 20 West, from A-R/36A (Agricultural-Residential/Thirty-six Acre Minimum Lot Size) zone to A-R (Agricultural-Residential/One Acre Minimum Lot Size) zone, in the Mohave County General Area (east of U.S. Highway 93 and south of White Hills Road), Mohave County, Arizona. Ms. Holmquist advised that the applicant had originally requested a split of the five acre piece into four one acre parcels, and since there was a concern raised by Deputy County Attorney, Christine Nelson, that the applicants son was also requesting a split on the adjacent parcel, the applicant was now not splitting the property and just wanted one four acre parcel to allow him to acquire a building permit. Steve Lee, Attorney for the applicant, gave extensive history regarding the applicants request and, in his opinion, the applicant was being punished because of the purchase of property, from a non-related owner of additional property, to gain access. Attorney Lee concluded by stating that the request, in his opinion, was consistent with the Countys General Plan. Attorney Nelson advised that, in her opinion, the applicant was pursuing a common plan to divide a parcel of land into more than six parcels without complying with state subdivision statutes and County subdivision regulations. In response to Chairman Byers, Attorney Nelson advised that there were already more adjoining parcels than the six that comprise a subdivision. Attorney Lee stated that, in his opinion, the applicant had not split any property, only purchased lots. Motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to adopt Board of Supervisors Resolution No. 2001-94 DENYING the rezone as stated, and as recommended by the Planning and Zoning Commission. ITEM 45: Motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to adopt Board of Supervisors Resolution No. 2001-95 DENYING the Rezone of the W SW SW SW of Section 21, Township 27 North, Range 20 West, from A-R/36A (Agricultural-Residential/Thirty-six Acre Minimum Lot Size) zone to A-R (Agricultural-Residential/One Acre Minimum Lot Size) zone, in the Mohave County General Area (east of U.S. Highway 93 and south of White Hills Road), Mohave County, Arizona, as stated, and as recommended by the Planning and Zoning Commission. ITEM 48: The meeting continued with the evaluation of a request for a Rezone of a portion of the NE SE SE SW and the NW SW SW SE of Section 12, lying westerly of the Interstate 40 Frontage Road Right-of-Way line, as shown on Record of Survey Book 19, Page 13, in Township 17 North, Range 18 West, from A (General) zone to C-MO (Commercial-Manufacturing/Open Lot Storage) zone, in the Yucca portion of the Mohave County General Area (west side of Interstate 40 Frontage Road, north of the West Yucca Interchange Exit Road), Mohave County, Arizona. Richard Knowles, owner of the property, addressed the Board advising that this request was to correct a zoning violation. Tom Price, Attorney for the applicant, advised that he was in attendance to address any legal issues. Roy Carlton, Elizabeth Carlton, and Ruland Hancock, Yucca residents, as well as Wendy Cavalliere, the applicant, addressed the Board in support of the Feed Store and, therefore, were in favor of the rezone. In response to Chairman Byer, Attorney Price advised that there was a civil/criminal entanglement with the adjoining property, but this property had nothing to do with this request. Motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to adopt Board of Supervisors Resolution No. 2001-100, as recommended by the Planning and Zoning Commission. ITEM 49: Gene Gordon, Sue Long, Cliff Whittaker, John Ford, and Susan Burkhardt, Dolan Springs residents, addressed the Board opposed to the strobe lights on the 1,300 foot FM radio broadcast antenna, citing that it was, in their opinion, an eye sore, the flashing red lights disturbing, did not benefit airplanes, causing seizures, wrong type of improvement, and were, therefore, in support of the tower being removed. Supervisor Sockwell advised that based on the number of signatures on petitions and the number of complaints received by his office, it was quite obvious that the applicant had not attempted to be a good neighbor to the community. Laura Mitchell, representing the applicant, Maguire Com, Co., advised that the wrong light kits had been installed, but they had just received the correct kits yesterday and would be reinstalled. Ms. Mitchell advised that the radio station was not broadcasting and, therefore, no power was coming from the tower at this time. In response to Chairman Byers, Attorney Nelson reviewed the revocation process of the Zoning Use Permit, stating that if it was the opinion of the Board and Planning and Zoning Commission, if the continued use of the property was contrary to the health, safety and welfare of the public, the Board could revoke Board of Supervisors Resolution No. 2000-108, Zoning Use Permit, and, therefore, the item should be referred back to the Commission for determination. In further response to Chairman Byers, Attorney Nelson advised that the current lights on the tower were not in compliance with Federal Aviation Administration requirements and if changed, the County would presume they would comply, which was a condition of the permit approval. Supervisor Sockwell advised that, in his opinion, the citizens of Dolan Springs had been very patient. Motion was made by Supervisor Sockwell to direct staff to start the required sixty day revocation process against the applicant. Chairman Byers advised that he would second the motion with the addition that this be legally permissible. Supervisor Johnson advised that he preferred the matter be sent back to the Planning and Zoning Commission. Director Ballard advised that the revocation process involved the Planning and Zoning Commission. A substitute motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to refer the matter back to the Planning and Zoning Commission to begin the revocation process. ITEM 50: A brief discussion ensued regarding Supervisor Johnsons suggestion that the Board consider the amendment of the policy regarding sale and/or lease of County property that would allow realtors to be compensated (perhaps 3%) for selling County owned land. Dave Hollingsworth, representing Hollingsworth Properties, addressed the Board in support of the compensation and, in his opinion, it was wise for the Board to address compensation. Motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to request that staff review the legality of amending the policy, with Chairman Byers to attend the meetings in this regard. ITEM 51: J.R. Bowman, Kingman resident, addressed the Board in support of retention of the property to allow for Library expansion, and, therefore, was not in favor of the County selling property located on Burbank Street adjacent to the County Library, and across from Centennial Park. Chuck Chlarson, Kingman resident, addressed the Board with a design and development plan for a family recreational center which would include a large lighted driving range, a par 3 golf course, video arcade, batting cages, Grand Prix Motor Race Way (go-carts) plus other features that would be developed later on the 34 acre parcel. Mr. Chlarson concluded that, in his opinion, this was an excellent use of the property, and he was therefore, in support of the County selling the property. Chairman Byers noted that while the property would need to be bid, he would suggest retention of some of the property for library expansion, and that the Food Bank was also looking to acquire an acre of land. In response to Supervisor Johnson, Mr. Chlarson advised that he would perhaps be interested in leasing, on a long term basis, but a lease was not his first choice. Supervisor Johnson advised that he would support leasing the property. Dave Hollingsworth, representing Hollingsworth Properties, stated that, in his opinion, the highest and best use for the property (behind the library west to the Wal-mart shopping center) was commercial, while the adjacent property north was not as valuable. Mr. Hollingsworth stated that deficiencies i.e. abandoned sewer plant, in the FEMA flood plain, no zoning would need to be taken into consideration in the appraisal of the property, and that he did have parties that were interested in the property. Elio Kahlife, representing Great American Investments, advised that he would be interested in developing the property as is, and there would be no problem with the County retaining property north of the library for expansion. In response to Chairman Byers, Attorney Ekstrom advised that it would not take a great deal of time to make an amendment to the policy, as discussed under Item 50, to allow a possible sale of the property as requested. As no action was required at this time, the motion made by Chairman Byers to develop a policy before voting on this issue, died for lack of a second. ITEM 55: Tom Griffin, representing some of the citizens affected by marriage licenses not being available in Bullhead City on the weekends, advised that it was an economic issue and the $30 charge was acceptable and, therefore, requested approval. Reverend Tom Harden, a Perfect Wedding in Bullhead City, advised that he as well as other local businesses were loosing business and, therefore, supported approval. A brief debate ensued regarding Supervisor Johnsons statement that he would support the $45 fee, with Clerk of Superior Court Tinnell advising, that in her opinion, the $30 fee was sufficient to cover the costs of the service. Motion was made by Supervisor Johnson, seconded by Chairman Byers, and unanimously carried to set a Public Hearing on April 2, 2001, to consider the establishment of fees for the sale of marriage licenses at the Mohave County Justice Complex in Bullhead City on weekends. ITEM 52: There being no public or written objection, motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to close the Public Hearing and approve the Amendment to the Mohave County Animal Control Ordinance as to the increase in the cost of spaying and neutering animals. ITEM 53: Motion was made by Supervisor Johnson, seconded by Chairman Byers, and unanimously carried to authorize payment of January and February invoices, billing statements, and claims for Superior Court mandated services of Juror Compensation, Legal Services, and Court Costs/Investigations in the amount of $39,876. ITEM 59: Delores Moscou, Lake Havasu City resident, addressed the Board in support of the closure of streets (subject to conditions) located in the Desert Hills area of Mohave County, Arizona, on March 10, 2001, from 8 AM to 6 PM (AZ time) for the purpose of the Desert Hills Fire District and Desert Hills Community Association conducting a Desert Hills Spring Fling Street Fair. In response to Mrs. Moscou, Attorney Ekstrom assured Mrs. Moscou that the contract would be received prior to the event. Motion was made by Supervisor Johnson, seconded by Supervisor Sockwell, and unanimously carried to approve the contract regarding the closure of the streets as stated. ITEM 56: Motion was made by Supervisor Johnson, seconded by Chairman Byers, and unanimously carried to approve Amendment No. 2, for the provider service agreement between Ventana Health Systems Inc., and Senior Programs for reimbursement of home delivered meals, as requested by Director Mead. ITEM 54: Motion was made by Chairman Byers, seconded by Supervisor Johnson, and unanimously carried to enter into an Intergovernmental Agreement with the City of Kingman for a Sheriffs Facility. ITEM 57: Motion was made by Chairman Byers, seconded by Supervisor Sockwell, and unanimously carried to reconsider A) Board of Supervisors Resolution No. 98-72, naming Double D Ranch Road in Sections 4 and 5, T21N, R10W and Sections 31 and 32 T22N, R10W, (Commission Recommended Approval Of Double D Ranch Road As The Proposed Road Name At The Commissions Meeting On January 14, 1998). B) Motion was made by Chairman Byers, seconded by Supervisor Sockwell, and unanimously carried to refer back to the Planning and Zoning Commission, Board of Supervisors Resolution No. 98-72, naming Double D Ranch Road in Sections 4 and 5, T21N, R10W and Sections 31 and 32 T22N, R10W. ITEM 58: Motion was made by Chairman Byers, and seconded by Supervisor Sockwell, to authorize and direct County staff and the Boards attorney to work with Judge Pope and the other Mohave County Judges and their attorneys to obtain a dismissal of Arizona Supreme Court Special Action captioned Mohave County, et al. v. Honorable Gary R. Pope, et al., CV-00-0196-SA, and a rescission of Mohave County Superior Court Administrative Orders 2000-20 and 2000-21. The following Roll Call votes were recorded: Supervisor Sockwell-Yes, Supervisor Johnson-No, Chairman Byers-Yes. Motion carried by majority vote. ITEM 60: Motion was made by Supervisor Sockwell, seconded by Supervisor Johnson, and unanimously carried to reconsider A) Board Resolution No. 2000-412 Request for a Rezone of Parcel 578, Stagecoach Trails at Santa Fe Ranch, Unit 7, in Section 25, Township 16 North, Range 17 West, from A-R/36A (Agricultural-Residential/Thirty-six Acre Minimum Lot Size) zone to A-R/8A (Agricultural-Residential/Eight Acre Minimum Lot Size) zone, in the Yucca portion of the Mohave County General Area (west of Alamo Road and north of Red Cloud Drive), Mohave County, Arizona, (Commission Approved By A 3-2 Vote Resolution No. 2000-412). B) Motion was made by Supervisor Sockwell, seconded by Supervisor Johnson, and unanimously carried to set a Public Hearing on April 2, 2001 - Board Resolution No. 2000-412 Request for a Rezone of Parcel 578, Stagecoach Trails at Santa Fe Ranch, as requested by Director Ballard. ITEM 61: Supervisor Johnson advised that no action was necessary regarding Mohave Countys intervention in Arizona Corporation Commission (ACC) Power Plant and Transmission Line Siting Committee hearings regarding Caithness Big Sandy Project procedural hearing scheduled for March 7, 2001, in preparation for an estimated two-day hearing to be held in April, 2001, after release of the Draft Environmental Impact Statement. ITEM 62: Motion was made by Supervisor Johnson, seconded by Chairman Byers, and unanimously carried to approve the Settlement Agreement and Release between Mohave County and Patricia Marie Pope. ITEM 63: Chairman Byers noted that no action was required regarding the Agreement to Terminate Indigent Defense Appeals Contract between the Superior Court of Arizona in and for the County of Mohave and Deborah A. Liverance. ITEM 64: Chairman Byers noted that no action was required regarding the Indigent Defense Appeals Agreement. ITEM 61: At the request of Attorney Herbert, it was clarified that no action was necessary and that Director Ballard and a member of the County Attorneys staff would attend and be a witness, on behalf of Mohave County, at any of the Arizona Corporation Hearings, regarding the Caithness Big Sandy Project, Power Plant and Transmission Line Siting Committee hearings.
