No. JCV-2000-0888-FF NOTICE OF PENDING FORFEITURE TO: ALL PERSON(S) CLAIMING TO BE AN INTEREST HOLDER IN THE PROPERTY DESCRIBED ABOVE: YOU ARE HEREBY GIVEN NOTICE pursuant to A.R.S. ßß 13-4306(C), 13-4307 and 13-4311 that an action as described in the above heading is pending in which the State of Arizona claims that the property described as 1-ROYAL POCKET ORGANIZER; 1-BLACK BRIEFCASE CONTAINING NUMEROUS KNIVES, AND A DOUBLE EDGED SWORD IN A SHEATH, is forfeited. The property has been seized for forfeiture by the State of Arizona pursuant to A.R.S. ßß 13-2314, 13-3413 and 13-4301, et seq. The seizure took place in Mohave County, Arizona. Any person claiming an interest in any of the subject property must file a verified claim satisfying the requirements of A.R.S. ß 13-4311(E) within thirty (30) days of service of this Notice. This claim is separate from and in addition to an Answer to a Complaint. Copies of the claim must be mailed to the seizing agency, LAKE HAVASU CITY POLICE DEPARTMENT, and to the attorney for the State, Deputy Mohave County Attorney, THOMAS D. TAYLOR, at the address at the top of this Notice. A.R.S. ß 13-4311(E) provides: E. The claim shall be signed by the claimant under penalty of perjury and shall set forth all of the following: 1. The name of the claimant. 2. The address at which he will accept further mailings from the court or attorney for the State. 3. The nature and extent of the claimant's interest in the property. 4. The time, transferor and circumstances of the claimant's acquisition of the interest in the property. 5. The specific provisions of this chapter relied on in asserting that it is not subject to forfeiture. 6. All facts supporting each such assertion. 7. Any additional facts supporting the claimant's claim. 8. The precise relief sought. Copies of the claim shall be mailed to the seizing agency and to the attorney for the State. No extensions of time for the filing of a claim may be granted. If no such claim is timely made, forfeiture of all interest in the defendant's property of any person who does not so claim will result. By law, no extension of time for the filing of the claim may be granted. The property was seized by the LAKE HAVASU CITY POLICE DEPARTMENT on the 7th day of December, 2000. If you have not previously received notice of its seizure for forfeiture, this is notice pursuant to A.R.S. ß 13-4306(C). In some circumstances, a person claiming a lawful interest may file an application under A.R.S. ß 13-4310(B) to obtain a hearing on the provisional return of the property pending the outcome of a judicial proceeding on its forfeiture.
