THE SCENIC IMPROVEMENT DISTRICT OF MOHAVE COUNTY, ARIZONA ADVERTISEMENT FOR PROPOSALS N O T I C E OF THE PASSAGE OF THE RESOLUTION ORDERING THE IMPROVEMENT AND INVITING SEALED PROPOSALS FOR THE IMPROVEMENT KNOWN AS: THE SCENIC IMPROVEMENT DISTRICT OF MOHAVE COUNTY, ARIZONA,  SCENIC STREET AND BRIDGE IMPROVEMENT PROJECT . DISTRICT S PROJECT NO. MC 01-5673, ENGINEER S PROJECT NO. 2169. THIS NOTICE IS GIVEN PURSUANT TO THE PROVISIONS OF SECTION 48-901 THROUGH 48-965, INCLUSIVE, ARIZONA REVISED STATUTES AND AMENDMENTS AND SUPPLEMENTS THERETO. On the 23rd day of July, 2001, the Board of Directors of Scenic Improvement District of Mohave County, Arizona, (the "District"), duly passed and adopted its Resolution No. 2001-03 ordering that the Work described in Resolution of Intention No. 2001-01 be done, said Resolution also directing this Notice to be given. THEREFORE, notice is hereby given that the Board of Directors of the District will receive Proposals for furnishing of all labor, material, transportation, services and equipment for the improvement of certain streets and/or roads within the District. The work consists of improving 4.2 miles of Scenic Boulevard, 3.0 miles of Elbow Canyon Road, 1.0 mile of Spring Rain Drive, 1.0 mile of Frehner Road, 1.25 miles of Las Vegas Way and a 485 foot Bridge across the Virgin River along Scenic Boulevard. The scope of work consists of furnishing all of the materials, labor and equipment for all clearing and grubbing, grading, earthwork, construction of drainage culvert structures, paved road overtopping structures, riprap installation, concrete slope protection, construction of bank protection, subgrade preparation, placing and finishing aggregate base course, placing and finishing asphaltic concrete pavement course, furnishing and providing all maintenance of traffic, materials testing, installation of survey monuments, installation of all required signs, roadway striping and markers, providing of construction water, providing sanitary restroom facilities, fencing, de-watering, reinforced concrete bridge construction, endangered species protection, cultural resource protection and any other materials, labor, equipment or work required for the completion of the Scenic Improvement District, Scenic Street and Bridge Improvement Project. Each Proposal to be made in accordance with the aforementioned Resolution of Intention on file in the office of the Clerk of said District; Plans, Specifications and other Proposal Documents and Contract Documents are now on file with the Clerk located at the Mohave County Administration Building, 809 E. Beale Street, Post Office Box 7000, Kingman, Arizona 86402-7000, and also with the Superintendent of Streets, located at 3675 East Andy Devine Avenue, Kingman, Arizona 86401, Post Office Box 7000, Kingman, Arizona 86402-7000, where they may be examined. A set of such documents may be obtained from Mohave County Public Works, located at 3675 E. Andy Devine Avenue, Post Office Box 7000, Kingman, Arizona 86402-7000, Phone: (928) 757-0914; or Bulloch Brothers Engineering, District Engineer, upon a $150.00 deposit. This deposit will not be refunded. A PRE-BID MEETING WILL BE HELD ON August 7, 2001 AT 10:00 A.M. IN THE DISTRICT ENGINEERS OFFICE, BULLOCH BROTHERS ENGINEERING, INC., 561 WEST MESQUITE BOULEVARD, MESQUITE, NEVADA 89024. ATTENDANCE WILL BE RECORDED. IT IS STRONGLY RECOMMENDED THAT ALL BIDDERS ATTEND. Bidders must be eligible to do said work under and in accordance with, and must agree to conform to, the laws of the State of Arizona. The five percent (5%) preference pursuant to A.R.S. 34-241 does not apply to this Project. Each Proposal shall be sealed in an envelope addressed to the Clerk of the Board of Supervisors of Mohave County, ex officio Clerk of the Board of Directors of the District and bearing the following statement on the outside of the envelope: " Sealed Proposal to Construct the Work for Scenic Improvement District of Mohave County, Arizona, Scenic Street and Bridge Improvement Project. District Project No. MC 01-5673, Engineer s Project No. 2169. " Date and Time of Bid Opening " Contractors Name and Address Each Proposal shall be made out in the form set forth in the Contract Documents and all pages of said Contract Documents book must be submitted as part of the Proposal and shall be accompanied by a Bid Bond acceptable to the District for not less than ten percent (10%) of the amount of the Bid made payable to Scenic Improvement District of Mohave County, Arizona. The abovementioned Bond shall be given as a guarantee that a Bidder will enter into the Contract if awarded to it, pursuant to the terms and conditions of the Bid Documents, which includes the said Contractor within ten (10) calendar days from the date of the Notice of Award entering into the Contract and providing the required Performance and Payment Bonds and Certificates of Insurance and Endorsements and any other documents or information required of the Bidder which is deemed necessary by the District for the District to enter into a written Contract with the Winning Bidder as Contractor. The Contractor and Bid Bond will be declared forfeited if the Winning Bidder refuses to enter into said Contract and supply the Bonds, Certificates, Endorsements and Information after being requested to do so by the District Clerk. All Proposals shall be filed with the Clerk of the District, Board Office, 809 E. Beale Street, Kingman, Arizona 86401, Post Office Box 7000, Kingman, Arizona 86402-7000, on or before August 20, 2001, at 9:00 a.m. All Proposals will be opened and the total amounts so Bid read aloud in a public meeting of the Board of Directors of the District held on such date. All Proposals shall be tabulated by the District Engineer and the Superintendent of Streets who shall report their findings to the Board of Directors of the District. It is expected that the Board of Directors will award the Contract to the lowest Bidder the Board of Directors determines to be and best responsible Bidder on August 20, 2001, at the meeting which will be held on such date. The Board of Directors reserve the right to reject any or all Proposals received and to waive any informalities or irregularities in the Proposals. The Board of Directors has determined that Improvement Bonds will be issued to represent the construction cost and all of the incidental costs of such Work and improvement, including engineering, printing, advertising and posting and preparation of proceedings; and notice is hereby given that such Bonds shall be issued under the provisions of A.R.S. 48-901 through 48-965, inclusive, and amendments thereto, by the District, but payable only out of a special fund collected in not to exceed fifteen (15) annual principal installments from the assessments of $25.00 or over remaining unpaid after the close of the cash collection period. The Bonds payable out of the first installment collected shall be payable on the first day of January next after the collection of the first installment of the assessments can be made under the provisions of A.R.S. 48-901 through 48- 965, inclusive, and amendments and supplements thereto, and on the first day of January of each year thereafter until all are paid. Said bonds shall bear interest at a rate of not to exceed twelve percent (12%) per annum. Interest will be payable on the first days of January and July of each year. THE CONTRACTOR WILL BE PAID WITH CASH PAYMENTS ONCE EACH MONTH, SUCH PAYMENTS TO BE ON THE BASIS OF NINETY PERCENT (90%) OF THE VALUE OF THE WORK ACTUALLY PERFORMED, AS DETERMINED BY THE DISTRICT ENGINEER. THE RETAINAGE WILL BE PAID UPON THE RECORDING BY THE SUPERINTENDENT OF STREETS OF THE CERTIFICATE OF SUBSTANTIAL COMPLETION OF THE WORK. THE CONTRACTOR S PAYMENTS WILL INCLUDE INCIDENTAL EXPENSES ALREADY INCURRED. THE CONTRACTOR WILL NOT BE RESPONSIBLE FOR MAKING CASH COLLECTIONS FROM PROPERTY OWNERS OR FROM THE BOND HOLDERS. Without charge, the District will provide the Winning Bidder with the opinion of Bond Attorney (Squire, Sanders & Dempsey L.L.P.) concerning the validity of the proceedings to and including the execution of the Construction Contract. The fees of said Bond Attorney will be paid directly to the District as a part of the incidental expenses. No Bidder may withdraw his Proposal for a period of one hundred fifty (150) days after the date set for the opening thereof. The District reserves the right to cancel or modify this Notice at any time.
